The 8-week car insurance rule: does treatment stop at 8 weeks?

The change on September 10th and the application of future treatment expenses on October 25th are different.

Know this first

The 8-week threshold in car insurance is not an automatic end to treatment. For certain patients with minor injuries from accidents on or after September 10, 2026, treatment beyond 8 weeks requires an additional review of medical necessity.

Changes to advance payment of future treatment expenses have a different starting point: automobile insurance contracts whose coverage begins on or after October 25, 2026. Do not judge both rules from the accident date alone.

What has changed in car insurance in 2026?

One is a procedure to review the need for treatment when certain minor injuries are treated for more than 8 weeks. The other is a change in the payment standard for ‘future treatment expenses’, which pays the expected treatment expenses in advance after treatment is completed. You must distinguish between the procedure for confirming the need for current treatment and the issue of payment for future treatment.

According to the Ministry of Land, Infrastructure and Transport, the review concerns specified sprains and bruises in injury grades 12–14. Pregnant patients and children aged 7 years or younger are exceptions to this review procedure. Do not assume that all patients described as having minor injuries follow the same procedure; check the injury and any applicable exception.

03

Why are the two dates different: September 10th and October 25th?

For treatment procedures exceeding 8 weeks, the date of the accident is considered, and the new standard for future treatment costs is the date of liability commencement of the insurance contract covering the accident. The liability commencement date is the date on which the insurance company's liability for coverage begins under the insurance contract.

  • September 10, 2026 — Applies to accidents on or on or after this date, for review of treatment beyond 8 weeks in eligible patients with minor injuries.
  • October 25, 2026 — Applies to automobile insurance contracts whose coverage begins on or on or after this date, for the new standards on advance payment of future treatment expenses.
04

Can I not get car insurance treatment after 8 weeks?

Treatment does not automatically end just because 8 weeks have passed. Eligible patients must submit medical certificates and other review materials to insurance companies and mutual aid associations, and undergo review by medical professionals within the Korea Automobile Compensation Promotion Agency to confirm the need for additional treatment.

The Ministry of Land, Infrastructure and Transport also provides guidance on the cost of issuing review documents, the burden of treatment costs before review completion, and the procedures for raising objections to the results. Please check the submitted submission deadline, required documents, result notification, and method of raising an objection. The fact that there is a review process should not be understood to mean that treatment duration or payment beyond 8 weeks is unconditionally guaranteed.

05

8 weeks does not cover the recovery period for all patients

The 8-week insurance administrative period does not represent a medical recovery period for everyone. The treatment will look at how long it has been since the accident, as well as current pain, movement, and limitations in daily life and their progress.

Preparing materials to explain treatment needs and verifying procedures can be an additional burden on patients. Symptom evaluation and guidance on administrative procedures must be provided together so that accident victims who need actual treatment are not disadvantaged due to ignorance of the system.

06

It's been 6 to 7 weeks since the accident, but what if symptoms remain?

Discuss with your medical staff whether further treatment is needed, and if you are eligible, check the documents and submission deadline in advance. It is better to describe your current discomfort in detail rather than waiting until the 8th week. If you have already received separate guidance, check the deadline written in that guidance.

The information below is not intended to secure insurance benefits, but is medical information for the medical staff to determine the current condition and need for treatment. Rather than inflating symptoms, communicate the changes and limitations you are actually experiencing.

  • Which part of the body hurts during which movement?
  • Do you experience any discomfort when sitting or standing for long periods of time?
  • Are there any restrictions while driving or working?
  • Do your headaches, dizziness, and numbness in your arms or legs remain or have they changed?
What to check if pain remains even if the X-ray is normal
07

Have future treatment costs changed since September 10th?

It is not accurate to say that the new payment standard for future treatment costs will be applied as September 10th. Article 2 of the Supplementary Provisions of the Insurance Business Supervision Implementation Rules <2026.8.28.> stipulates that the amendments shall be applied ‘from contracts for which liability begins on or after October 25, 2026.’

Usually, you can think of a contract that is newly signed up or renewed on or after October 25th and the insurance period begins. However, rather than judging based solely on the date of application for subscription or the date of receipt of renewal notice, you should check the actual liability start date of the insurance contract applicable to the accident in question.

08

Are all accidents on or after October 25th the new standard?

no. Even if the accident occurred on or after October 25th, if the liability start date of the contract compensating for the accident is before then, the new standard for future medical expenses cannot be considered to apply based solely on the date of the accident.

For example, if an accident is covered in November 2026 under a contract with an insurance period from June 1, 2026 to May 31, 2027, the fact that the accident occurred in November and the contract's liability start date are separate. For a third-party bodily injury claim, the other vehicle's insurance contract may be involved, so don't just check your own insurance renewal date.

09

What should I check if I receive notice of a change in future treatment costs from the insurance company?

Knowing what changes are being described and under which contract they apply can help avoid confusion between the two dates. Use the following questions to contrast your thinking with the guidance.

  • Is the change you are talking about a change in treatment costs for more than 8 weeks that will be applied from the accident on September 10th, or a change in future treatment costs that will be applied to contracts that begin liability on or after October 25th?
  • When is the liability start date for the car insurance contract applicable to my accident?
  • On what basis does the new standard apply to this accident and what are the terms and conditions?
10

If I have an existing contract, can I definitely receive future treatment expenses?

Just because the new standards do not apply does not necessarily mean that future treatment costs will be paid under the old method. Existing future treatment expenses are customarily paid during the settlement process between the insurance company and the victim.

‘Whether the new standard is applied’ and ‘how future treatment costs are handled in the actual settlement process’ are separate issues. Payment should not be guaranteed just because it is an existing contract, or the same conclusion should not be applied to all accidents simply because the system has changed.

Four things traffic accident patients should check now

The fact that the system has changed and the fact that its rules actually apply to my thinking are not the same thing. Please check the four items below.

  • Check the accident date.
  • Check the liability start date of the car insurance contract covering the accident.
  • Describe any remaining symptoms in detail to the medical staff.
  • If treatment is needed when the 8-week period is approaching, check the applicable eligibility, documents, and submission deadline in advance.
12

Even if the system changes, the need for treatment must be judged based on the current condition.

Your current condition must be assessed to determine whether to continue or adjust treatment. At Namugeuneul Korean Medicine Clinic, we check the course of accidents, changes in pain, movement, and discomfort in daily life.

Rather than hastily discontinuing necessary treatment after just hearing an explanation of the system change, check to see what regulations apply to your accident and what evaluation you need now.

Please let us know if your symptoms change during treatment

Apart from preparing documents, changes in symptoms must be checked at the clinic.

  • If the location or intensity of pain has changed compared to the beginning
  • If you have new numbness in your arms or legs or discomfort in movement
  • If you continue to have difficulty driving, working, or sleeping
